These Terms of Service ("Terms") govern your use of the MaxScales website at maxscales.net and any services provided by MaxScales ("we," "us," or "our"). By accessing our site or engaging our services, you agree to these Terms.
MaxScales provides web design, web development, and related digital services. The scope, deliverables, timeline, and pricing for each project are agreed upon between MaxScales and the client prior to work beginning, either verbally or in writing.
To ensure timely delivery, clients agree to:
Delays caused by the client may result in revised timelines or additional charges.
Each package includes a set number of revision rounds as discussed at project kickoff. Revisions beyond the agreed scope may be billed at our standard hourly rate.
Upon receipt of full payment, the client owns the final website design and content delivered. MaxScales retains the right to display the project in our portfolio and use it for promotional purposes unless the client requests otherwise in writing.
Any third-party assets (fonts, stock images, plugins) used in the project are subject to their respective licenses. It is the client's responsibility to maintain any required licenses after delivery.
If MaxScales provides hosting, we will make reasonable efforts to maintain uptime and security. We are not liable for downtime caused by third-party infrastructure providers (e.g. Cloudflare, server providers). Clients who cancel hosting will receive their site files within 14 days of cancellation.
MaxScales is not liable for any indirect, incidental, or consequential damages arising from use of our services, including but not limited to lost revenue, lost data, or business interruption. Our total liability for any claim is limited to the amount paid for the specific service in question.
We warrant that work will be completed with reasonable skill and care. We do not guarantee specific business outcomes (e.g. search rankings, conversion rates, or revenue) from a website we build.
Either party may terminate a project engagement with written notice. If MaxScales terminates a project without cause, a prorated refund of unused fees will be issued. If a client terminates after work has begun, fees for completed work are non-refundable.
These Terms are governed by the laws of the jurisdiction in which MaxScales operates. Any disputes will be resolved through good-faith negotiation before pursuing formal legal action.
We reserve the right to update these Terms at any time. The "Last updated" date reflects the most recent changes. Continued use of our services constitutes acceptance of the revised Terms.
